Form ADV and RIA Filing Requirements
Rule 204-1 requires an adviser to amend Form ADV at least once a year, within 90 days after the end of its fiscal year, and promptly whenever certain information becomes inaccurate. Rule 204-3 governs delivery of the Part 2 brochure, and Rule 204-5 governs Form CRS for advisers with retail investors.
Depending on the business, an adviser may also file Form PF, Form 13F, Schedules 13D and 13G and state notice filings. A missed annual amendment is one of the simplest findings for an examiner to make.
